A legislator (or lawmaker) is a person who writes and passes laws, especially someone who is a member of a legislature. Legislators are usually politicians and are often elected by the people. Legislatures may be supra-national (for example, the United Nations General Assembly), national (for example, the United States Congress), regional (for example, the Scottish Parliament) or local (for example, local authorities).

The political theory of the separation of powers requires legislators to be different individuals from the members of the executive and the judiciary. Certain political systems adhere to this principle, others do not. In the United Kingdom, for example, the executive is formed almost exclusively from legislators (members of Parliament) although the judiciary is mostly independent (until reforms in 2005, the Lord Chancellor uniquely was a legislator, a member of the executive (indeed, the Cabinet), and a judge).

In continental European jurisprudence and legal discussion, "the legislator" (le législateur) is the abstract entity which has produced the laws. When there is room for interpretation, the intents of the legislator will be questioned, and the court is supposed to rule in the direction that it judges to fit the legislative intent the best — which can be uneasy, in the case of conflicting laws or constitutional provisions.

The Parliament of Canada is Canada's legislative branch, seated at Parliament Hill in Ottawa, Ontario. According to Section 17 of the Constitution Act, 1867, Parliament consists of three components: the Sovereign, the Senate, and the House of Commons. The Sovereign is normally represented by the Governor General, who appoints the 105 members of the Senate on the recommendation of the Prime Minister. The 308 members of the House of Commons are directly elected by the people, with each member representing a single electoral district, frequently called a constituency or a "Riding".

The lower house, the House of Commons, is the dominant branch of the Canadian Parliament. The upper house, the Senate, rarely opposes the will of the other Chamber, and the duties of the Sovereign and Governor General are largely ceremonial, as in theory he or she could refuse to sign a bill, and could dismiss the cabinet and call an election unprompted. The Prime Minister and Cabinet must retain the support of a majority of members of the Lower House to remain in office; they need not have the confidence of the Upper House.

The current Parliament is the 39th since Confederation.
